torsion axle advice

Good buddy of mine has a 03 197. The trailer tire on the port side of the boat is real close to the fender. So he took the arm off the spline that comes out of the torsion axle and moved it down a couple of teeth and put it back on. When it was put back together there was equal amount of space from the tire to fender on each side. It was fine for a couple of weeks then this last weekend when he pulled it out the tire was close to the fender again. I am wondering if his torsion axle is failing. Anyone have any ideas or suggestions.
