Need suggestion/advice

Memorial Day I hit a floating object and bent everything under my boat (strut, prop, shaft & rudder) ordered parts from a MC dealer (forum member). Upon getting ready to install found shaft to be the wrong one (everything else ok). Called & returned shaft, dealer asked me to return old one etc.

We use our boat to do handicap water sports for a local rehab hospital and I told the dealer I needed a shaft ASAP. I was told he could not do it and I told him I would have to see what I could do because time was my problem. Secured shaft from another source to repair my boat so it would be ready for the date I promised to be at upcoming event. This was in late July--called dealer about refund and was promised it to be coming but said a restocking fee would most likely be applied and I said I didn't think that was appropriate. I ordered from him because of his apparent good reputation and knowledge of MC so wrong part was not thought about.

Check for refund less 15% restock and NO compensation for original freight or my cost to return was in the check. This is Sept. and check came 8/31. I made several contacts via email asking for refund and then after this time period I received what I got. They did not reply to my last email asking for full refund.

Any suggestions?? thanks-

Did you order by part number or by year and model of boat?

If you placed order and left the determination of part # up to the dealer, then the fact he sent the wrong part is his problem.

If you ordered a part # and it was wrong, your problem and re-stocking fee is justifiable.

I ordered based on year make model not by a part number I suppied. Yes, it was BaY Area. I felt they were knowledgable and well versed as to my boat and the needs I had. Was not connacted to find out if other info was needed. I trusted them---

If I had ordered a part, answered the reps questions accurately, and still received the wrong part, I would not pay shipping or restocking because I did not make a mistake.

Any pertinent information we are missing here?

Can't argue with this.

If its true what you say.......

Sounds like fraud to me......appears that they lack integrity and just the old "Good Customer Service"!! Thanks for the post/heads up! This thread will be interesting to follow.

Let's not get ahead of ourselves - with Jim and BAWS. I would not throw the word "Fraud" around so quick.
