I have seen lots of towers, and some towers with bent flanges and joints similar to that, but NEVER one where they claimed that was "as designed". IMO, you have a bent flange and clevis, but no clue how it might have happened. The rubber grommets on the flange suggest it is supposed to line-up nicely then snug down. If it were me I would take a big crescent wrench and gently bend the pieces back into alignment then make sure the bolts are tightened properly.
