We had a debate on the water the other day. Can you drink a beer or two on the boat in NC or is it like the old days in the car.... anyone but the driver is OK with open container?

Depends on the lake. On Wylie for instance, alcohol on the boat is ok as long as the driver doesn't have at least .08 blood alcohol. On my home lake no alcohol on the lake period..

Not that it answers your question, but in Ca anybody can drink including the driver. BUT.....the driver can't be over .08.

My boat drinks beer, will the driver and passangers be drunk if the exhaust pipes blow an .08?

In NC it is based on the lake itself. Several of the lakes are city owned reservoirs and you usually can't drink. But Falls, Gaston, Jordan, etc.. are all OK to drink on. Road rules still apply to the driver though, and there are laws about being towed while intoxicated.
